Excerpt from Documents of the Assembly of the State of New-York, Vol. 3: Fifty-Eighth Session, 1835Added to this is the certificate, n0t sworn to, of Alanson Sum ner, superintendent on that part of the canal where the accident occurred, who certifies that the side cut alluded to is located so near the lock as to endanger teams, &c. Of those navigating the canal, when not covered. That part of it into which the horse was drawn was the bulk head; and in raising and lowering the the feeder gates, the covering had been omitted and not placed on by the man managing the gate: That he was not at home at the time the accident happened; but from all his information on the subject, he had no hesitation in expressing a belief that it could not be charged to any carelessness in managing the horses.
