To me it would've made more sense if Dumbledore had just started scooping out the Potion
to get to the Horcrux instead of just drinking it and telling Harry that if he says he doesn't
want to drink anymore for Harry to force him to continue drinking. I would've used the cup
to scoop out the potion. Wouild that have been considered cheating???? Or too obvious of
an option for Professor Dumbledore to even consider doing at the time????

Doesn't it refill if it's not drunk?

I believe he's dying anyway as well.

I thought it was because Dumbledore knew that he couldn't empty it any other way. It seemed to be a condition imposed by the spell that placed it there, as a deterrent, to make sure there was a heavy cost if anyone was that determined to get it.
