The author argues that the Americans with Disabilities Act (ADA) of 1990 has not fulfilled its potential primarily because of the judiciary's "disabling interpretations" in adjudicating ADA claims. In a decade of litigation, judicial interpretation of the law has largely constricted the parameters of disability rights and excluded large numbers of claimants from the reach of the law.

Things have changed a bit since this book was published, but it was assigned to me for a class back in grad school, so before I get rid of it I figured I ought to actually read it, not just the paragraphs we focused on in class way back when. "Don't Ask, Don't Tell" had not yet been repealed and there have been a few new marriage and adoption cases since this book was written. Still, the history covered in this book is fairly well-written and one could probably follow it even without a law background. There is a lot of jargon, enough to easily understand why the general public doesn't follow the courts and legislature very successfully.… (meer)
